Introduction

Austin Search Partners, LLC dba SF Search (“Austin Search Partners” or “we” or “us”) has created this Privacy Policy in order to disclose its use of personal data collected about you. The following discloses Austin Search Partners’ information gathering and dissemination practices for its website.

Information Collected and Received

Austin Search Partners collects data on individuals and companies in order to provide executive search and recruiting services to our clients.

This information includes, but is not limited to, the information generally provided in a resume (i.e., a document used by a person to present their professional and educational background and skills, also known as a “résumé,” “curriculum vitae,” or “CV”), such as professional contact information, including name, job title, address, phone number, fax number, e-mail address, salary/compensation, significant skills, previous positions held and educational background. Austin Search Partners does not collect more sensitive personal information and recommends you do not reveal sensitive personal data to us such as: racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, genetic data, bio-metric data, or health data or data related to sexual orientation or gender identification. Personal data relating to criminal convictions and offenses is not collected by Austin Search Partners.

We also research and collect information on companies, such as size, locations, industries, subsidiaries, public/private status as well as recent company-related news, management backgrounds, regulatory filings and M&A activity.

For our own business purposes, we also research and collect information on individuals and companies that allows us to evaluate whether or not we should contact them.

The majority of the personal information that we collect is sent to us by potential candidates in the form of resumes, digitally. These may be in response to a request from Austin Search Partners to provide such information or they may be sent to Austin Search Partners without prior contact, either in relation to a specific retained search and recruiting project, or in an unsolicited manner. As discussed below, Austin Search Partners also bolsters the information candidates send us, with the information it gathers from publicly available sources, such as LinkedIn.

In addition to resume information, Austin Search Partners may collect information on individuals and companies from a variety of online and offline public, published sources (“Public Sources”). Examples of data vendors which Austin Search Partners may us include D&B Hoovers, PrivCo, Leadership Directories, and other subscription-based databases. Examples of other online sources are regulatory filings, company websites, published conference proceedings, trade publications, social media and networks, such as LinkedIn, and public sector information.

Examples of offline sources are “Book of Lists” and similar publications by business journals, chambers of commerce and similar organizations, published trade or professional organization directories, and newspaper and other serial publications.

If you wish to be considered as a potential candidate for any of the services we offer to our clients, you may provide us with a resume. As part of our services, you may be asked for more detailed information. You may choose, at any time, not to disclose additional personal information however, in situations where you choose to withhold personal information requested by us, it may no longer be possible for you to be considered as a candidate.

In compliance with state-specific laws, Austin Search Partners will not inquire with candidates about salary history in states where it is regulated, however such information may be collected if voluntarily provided by candidates.

Uses of Information

Except as described in this section, we will not disclose your personal information to any third party without notifying you of our intent to share the information and giving you an opportunity to prevent your information from being shared.

Austin Search Partners uses the information that we collect to provide executive search and recruiting services to our clients.

Data collected initially from public sources is used for contacting potential candidates in order to assess whether a candidate would be an appropriate possibility for a position we are trying to fill. Data we collect from candidates and potential candidates is utilized in order to present them to client companies. We will not share the data you gave us with any third party other than a potential employer that is our client, unless and except we receive clear and explicit authorization from you for a broader distribution.

If you do not agree with our use of your data, please refrain from sending it to us.

Austin Search Partners reserves the right to disclose information when required by law.

We occasionally use other companies to perform services necessary to our operations. In the course of providing these services, those companies may have access to your personal information. By contractual agreement, those companies must treat your information in accordance with this Privacy Policy. However, we will not be liable for any damages that may result from the misuse of your personal information by these companies.

WE WILL NEVER SELL YOUR EMAIL ADDRESS, OR ANY OTHER PERSONAL INFORMATION, TO ANY THIRD PARTY WITHOUT YOUR PERMISSION (EXCEPT AS PART OF THE SALE OF THE BUSINESS OR A SALE/MERGER INVOLVING ALL OR SUBSTANTIALLY ALL OF ITS ASSETS.

Deletion of Data

Unless you give us your instruction to delete your data, we will keep your data for future searches or opportunities. You may withdraw your consent at any time with an email to info@austinsearchpartners.com.

We retain anonymized salary / compensation information related to specific positions with different companies to keep ourselves informed and to inform prospective candidates of expected salary ranges for those positions.

Children’s Privacy

We do not knowingly collect any information from anyone who we know to be under the age of 13. If you are under the age of 18, you should use this website only with the involvement of a parent or guardian and should not submit any personal information to us. If we discover that a person under the age of 13 has provided us with any personal information, we will use commercially reasonable efforts to delete such person’s personal information from all Austin Search Partners’ systems.

Security

Austin Search Partners follows generally accepted industry standards to protect the information submitted to us once we receive it. We maintain administrative and technical safeguards to protect your data against accidental or unlawful destruction, accidental loss, unauthorized alteration, unauthorized disclosure or access, misuse, and any other unlawful form of processing of the personal data in our possession.

No method of transmission over the Internet or method of electronic storage is 100% secure. We cannot ensure or warrant the security of any information you transmit to us, and you do so at your own risk. We also cannot guarantee that such information may not be accessed, disclosed, altered, or destroyed by breach of any of our safeguards. If we learn of a security systems breach, we will inform you of the occurrence of the breach in accordance with applicable law(s).

Cookies

“Cookies” are small pieces of information that are stored by your browser on your computer’s hard drive. At this time, the Austin Search Partners site does not use cookies.

Austin Search Partners may create links to other web sites. Austin Search Partners will make a reasonable effort to link only to sites that meet similar standards for maintaining each individual’s right to privacy. However, many other sites that are not associated or authorized by Austin Search Partners may have links leading to our site. Austin Search Partners cannot control these links and Austin Search Partners is not responsible for any content appearing on these sites.

Amendment

Austin Search Partners may amend this policy at any time. If Austin Search Partners is going to use personally identifiable information collected through the Austin Search Partners site in a manner materially different from that stated at the time of collection, Austin Search Partners will notify you via email thirty (30) days prior to such use. This Privacy Policy may not be otherwise amended except in a writing that specifically refers to this Privacy Policy and is physically signed by both parties.

This Privacy Policy inures to the benefit of successors and assigns of Austin Search Partners.
